Oregon authorities argued that this storage violated state water laws and interfered with existing water rights, which can be legally allocated under the state’s prior-appropriation system.
That distinction is important for homeowners. A small container collecting roof runoff is generally very different from ponds, dams, or reservoirs that capture natural streamflow. Laws can vary significantly between states and local jurisdictions, depending on the water source, amount collected, and effect on waterways. Before installing anything more complex than a basic rain barrel, check applicable local regulations.
